First I desire that all my just debts and funeral and Probate charges be fully paid. Item: I give and bequeath unto James Barber and Thomas Barber my sons, the sum of four hundred pounds of lawful Money of Great Britain upon Trust, to put, place or contrive the same at Interest upon Government or good real security in the names of them the said James Barber and Thomas Barber or the survivor of them or the Exors. (Executors) or Admors. (Administrators) of such survivor and to receive the interest Dividends and annual produce thereof where and as the same shall become due and payable and to lay out and invest the said interest Dividends and Annual produce from time to time as the same shall be received upon the like security so that the same may accumulate at compound interest until the youngest surviving Child of Elizabeth Hamerton my late deceased Daughter, shall attain the age of twenty one years and when and as soon as the said youngest surviving child shall attain the said age upon Trust to pay and divide the said Principal sum of Four Hundred Pounds together with all the Interest Dividends and Accumulations and Profits which shall have been made of the same equally to and between all and every the children of my said daughter Elizabeth Hamerton which shall be then living, share and share alike if more than one and if there shall be more than one such child that shall live to the age of twenty one years then upon trust to pay the whole thereof to such one child on attaining that said age.
And if all the said children should die before attaining the said age of twenty one years then from and immediately after the decease of the survivor of the said children so dying under the said age as aforesaid upon Trust to pay the said sum of Four Hundred Pounds together with all the interest dividends accumulations and profits which shall have been made or derived therefrom, equally to and between my children James Barber Thomas Barber William Barber Stephen Gotterson Barber Mary Soame and Ann Curtis, share and share alike and all the Rest Residue and Remainder of my Estate and effects of what nature of kind soever,
I give and bequeath equally to and between my said children, James Barber Thomas Barber William Barber Stephen Gotterson Barber Mary Soame and Ann Curtis, share and share alike. And I do declare that the said Shares of Residue shall be paid and payable six months after my decease and my mind and will is that my said Trustees hereinbefore named and the survivor of them and the Exors. and Admors. of such survivor as often as they shall think proper, shall and may through the Securities upon which the said Trust Monies shall hereafter be placed out and shall and may at all times in the first place reimburse themselves respectively out of the said Trust Monies, all such costs charges Damages and Expenses as they or any or either of them shall or may at any time expend or be put unto for or by reason or means of all or any or either of the Trust hereby in them reposed and that neither of them shall be answerable for any loss which may happen to any of the Trust Monies unless such loss shall happen through his or their wilful neglect or default nor the one for the other of them nor for more monies than shall actually come to each of their hands respectively but each of them for his own Acts ........ Receipts(?) Neglects and defaults only.
And lastly I do hereby nominate, institute and appoint the said James Barber and Thomas Barber, Executors of this my Will thereby revoking all former and other Wills by me at any time herebefore made and declaring this only to be my last Will and Testament in Witness whereof I have set my hand and seal this eleventh day of March one thousand eight hundred and twelve.
Signed sealed published and declared by the said Testator as and for his last Will and Testament in the presence of us Saml. Jeffery Shaw, Ann Shaw, both of Aylsham in Norfolk.
PROVED at London 26 April 1814 before the Judge by the Oaths of James Barber and Thomas Barber the Sons and Executors to whom Admon. was granted having first sworn (by Comon.(?)) duly to admr.
