Effects sworn under £
First I do hereby give will and devise unto Sarah my Wife and her Assigns for and during the term of her natural Life or for as long time thereof as she shall remain a Widow but no longer All and every my Messuages Lands Tenements and Hereditaments whatsoever situate lying and being in Gorleston aforesaid or in any Town Parish or Place thereto contiguous or near
And all other my Real Estate whatsoever and wheresoever with their and every of their Rights Members and Appurtenances, she my said Wife and her Assigns during all that time keeping and maintaining the same in good and tenantable repair and committing or suffering no waste therein
And from and immediately after my said Wifes decease or Marriage (which shall first happen) I do give and devise All and every the said Messuages Lands Tenements Hereditaments and Real Estate unto and equally to be divided between or amongst my Daughter Margaret Calver Widow and her two Children James Calver and Sarah Calver and the respective Heirs and Assigns of the said Margaret Calver James Calver and Sarah Calver for ever as Tenants in common and not as joint Tenants
Also I do give and bequeath to the said Margaret Calver my Wife for and during her Life or for so long time thereof as she shall remain a Widow and no longer, the Use, but not the property of all and singular my Fishing Boats and other Boats and Vessels, with the Ropes Nets Materials and stores belonging to or on board the same
And also my ready monies and securities for money Debts due and owing to me, Household Furniture, Plate, China and Linen, and all other my personal Estate and Effects whatsoever which shall remain clear after payment of my just debts funeral Expenses and the Charge of the Probate of this my Will
In Trust and to the intent that she my said Wife and my Executors hereinafter named may use manage and carry on the same for and towards her maintenance and support during her said Life or Widowhood keeping the same in good and sufficient repair and Condition (casual Loans of any of the said Boats or of their Nets Materials or Stores and regular and unavoidable Wear and Tear always excepted)
And from and after my said Wifes decease or marriage (which shall happen first) I do give and bequeath all my said Boats or Vessels Nets Materials Stores Household Furniture and other my personal Estate and Effects aforesaid unto my said Daughter Margaret Calver to and for her own proper use and benefit
And I do hereby make constitute and appoint my Brother Giles Shall and my Friend William Larke of Gorleston aforesaid Joiner Executors of this my Will
And Lastly I do hereby revoke all former Wills by me made and declare this only to be my last Will and Testament
In Witness whereof unto this my last Will and Testament contained and written on two sheets of Paper together annexed I the said Testator James Shall have to each sheet thereof set my Hand and Seal this thirteenth day of February one Thousand eight hundred and thirteen
The Mark of X James Shall Signed sealed published and declared by the said Testator James Shall as and for his last Will
and Testament in the presence of us, who in his presence, at his request, and the presence of each other have subscribed our Names as Witnesses hereto
This Will was proved at Yarmouth on the 30th day of June 1827 Before the Revd. Richard Turner[?] Clk Surrogate duly appointed of the Worshipful William Yonge Clk A. M. Official Principal of the Episcopal Consistorial Court of Norwich lawfully constituted & was approved &c &c administration of all & singular the Goods &c of the within named James Shall the Testator deceased, was then duly granted to William Lark the surviving executor within named he being duly sworn &c saving &c
