of Hackford (by Hingham), Norfolk
1764

In the Name of God Amen I William Mallett of Hackford in the County of Norfolk Carpenter being of Sound and Disposing Mind and Memory and Understanding thanks to Almight God yet Considering the Uncertainty of Life Do make publish and Declare this my last will & Testament in mode & form following (that is to say) First I Give & Devise all and singular of my Messuage & Lands & Grounds situate lying & being in Hackford Norfolk unto Mary Mallett my Loving Wife and her Assigns for and During the Form of her natural Life and from and immediately after her Demise I Give & Devise All that Messuage or Tenement wherein I now Dwell with the Outhouses & yards & Lands & Grounds thereunto belonging now in my hands & situate lying and being in the Hackford aforesaid unto William Mallett my son & his Heirs Charge & chargeable never the less with the payment of an Annuity or Yearly Rent Charge of forty shillings of lawful Money of Great Britain unto Stephen Mallett my son & his assigns for and during the Form of his Natural Life Clear of all Taxes and Deductions whatsoever by two even and Equal payments the first of the said payments to begin within Six Calendar months next after the Decease of the said Mary my Wife And my will and mind is that if Default shall happen to be made of or in the payment of the said Annuity or Yearly Rent Charge it shall and maybe lawfull to and for the said Stephen Mallett my son & his assigns unto the said premises hereby Given & Devised or unto any part thereof to Enter & to hold possess & Enjoy the same and take the Rents & profitts threof till there be lawfully paid & Satisfied not only the said Annuity and all arrears thereof (if any shall be) But also Costs Charges or Damages & Expense which he or they shall or may Sustain or be put to or unto by reason or means of such non-payment and Entry And immediately from and after the Decease of the said Mary my wife I Give and Devise all those two Messuages or Tenements with the Yards and Lands threunto belonging situate lying & being in Hackford aforesaid now in the Use of William Pitts and William Wick unto John Mallett my son and his Heirs upon & under this Condition & Trust namely that both the said John Mallett and his heirs shall & will to all and truly pay or cause to be paid unto the said Stephen Mallett my son the sum of Ten pounds in Good and lawfull money of this nation in Manner following (that is to say) the sum of Forty shillings part thereof within one year next after the Decease of the said Mary my wife and So from henceforth the sum of forty shillings a Year Yearly every Year until the said sum of ten pounds shall be fully paid and satisfied And in Case of Default be made in payment of the said Ten pounds or any part thereof at the Tymes aforesaid That then it shall be lawfull to and for the said Stephen Mallett to Enter into and Enjoy the said last mentioned premises and Hold & Enjoy the same until he be fully paid his said Legacy of Ten pounds or so much thererof as shall be then due together with his full Costs & Charges in entering the same And immediately after the said Decease of the said Mary my wife I Give & Devise all that Messuage or Tenement with the Lands & Yards thereto belonging situate or lying in Hackford aforesaid now in the Use or Occupation of John Reynolds unto Mary Eke my daughter and her heirs upon and under this Condition & Trust nevertheless that so the said Mary Eke or her heirs shalll & will well & truly pay or Cause to be paid unto Anna Mallett my daughter the sum of Ten pounds of like lawfull Money in Manner there following (that is to say) the sum of Forty shillings part thereof within one year next of the Decease of the said Mary my wife and so from then on further the sum of Forty shillings a Year Yearly every year until the said sum of ten pounds shall be fully paid & satisfied And in Case of Default be found in payment of the said Ten pounds or any part thereof it shall or may be lawfull for the said Ann Mallett to Enter into & upon the last mentioned premises and hold & Enjoy the same until she shall be fully paid of her said Legacy of ten pounds or so much thereof as shall be due together with her full Costs & Charges in recovering the same And from & immediately after the Decease of the said Mary my wife I Give & Devise All that Messuage or Tenement together with the Yards about thereunto belonging situate lying & being in Hackford aforesaid & Now in the use of Azarius Porter unto the said Ann Mallett my daughter & her heirs. Also>/b> I Give & Bequeath unto Christopher Mallett my son the sum of Five shillings to be paid to him by my Executrix hereafter named within one month next after my Decease. And so Lastly I do hereby make nominate and appoint the said Mary my Wife Sole Executrix of this my last Will & Testament to whom Mb>I Give & Bequest all the Rest & Residue of my Goods, Chattels & personal Estate of whatsoever make or Kind whatever remaining after payment of my Debts & Legacies Charges of proving this my Will and from all other Charges In Witness therof I the said William Mallet have Signed Sealed published & Declared this my last will & Testament Contained in Two Sheets of Paper To the first I have set my hand & to the last my Seal thos Seventh day of August in the Year of our Lord One thousand seven hundred & sixty two
